Resumo: Esta investigação tem caráter interdisciplinar, procurando conduzir um diálogo entre Geologia Ambiental, Fitogeografia e outras ciências dedicadas à conservação de recursos naturais e o Direito. Analisa-se a compatibilidade entre condições naturais próprias para a conservação do Cerrado, com suas diferentes formas de vegetação e de vida em geral, e a legislação florestal em vigor. Toma-se como eixo condutor dessa análise a continuidade floral – aqui compreendida, com apoio na literatura científica, como uma condição necessária para o bom funcionamento e para a conservação do sistema geombiental enfocado. Com base na Teoria dos Aspectos Modais, formulada pelo filósofo e jurista holandês Herman Dooyeweerd, compreende-se que as leis naturais que regem o funcionamento dos sistemas geoambientais (categoria espacial) devem ser respeitadas quando dos processos de elaboração, interpretação, aplicação e revisão da legislação pertinente a tais sistemas. A legislação florestal, uma manifestação do aspecto modal jurídico, será considerada compatível com a conservação dos sistemas geoambientais (que funcionam sob as leis decorrentes da inter-relação entre os aspectos modais espacial, cinemático, físico-químico e biótico) se for capaz de assegurar a preservação da continuidade floral. Assumindo-se essa perspectiva, examina-se o processo de ocupação da região da sub-bacia do ribeirão Entre-Ribeiros, bacia do rio Paracatu, localizada no Nordeste do Estado de Minas Gerais, Brasil, no intervalo 1964-2008. Examina-se, adicionalmente, em que medida a atual legislação florestal brasileira foi capaz de deter ou, ao contrário, de estimular a quebra da continuidade floral (fragmentação de ecossistemas) e a perda de biodiversidade na referida região durante o intervalo de tempo considerado.
Resumo em outra língua: The present work has an interdisciplinary approach and attempted to conduct a dialogue amongst Environmental Geology, Phytogeography and other Sciences dedicated to the conservation of natural resources with Law. One analyses the compatibility between the natural conditions that are adequate to the conservation of the Brazilian outback biome, known as Cerrado and composed of a rich variety of vegetation forms and life in general, with the ruling Forest Law. The axis conducting the present analysis is floral continuity – which was understood in the present work as a condition necessary for the good functioning and for the conservation of the focused geological-environmental system. Based upon the General Theory of the Modal Spheres formulated by the Dutch philosopher and jurist Herman Dooyeweerd, one considers that the natural laws that rule the geological-environmental systems (spatial referential) must be kept in mind during the processes of creation, interpretation, enforcement and review of the laws regarding such systems. The Forest Law, a manifestation of a modal juridical aspect, will only be considered compatible with the conservation of the geological-environmental systems (that work under the law resultant from the interrelation between the following aspects: spatial referential, cinematic, physical-chemical and biotic) provided it is capable of ensuring the preservation of floral continuity. Based upon this perspective, one examines the process of occupation of the region of the sub-basin of Entre-Ribeiros River, located in the basin of Paracatu River, in the Northeastern part of the State of Minas Gerais, Brazil, from 1964 to 2008. Moreover, one examined up to what measure the current Brazilian Forest Law was capable of detaining or, in the contrary, stimulating the break of floral continuity (fragmentation of ecosystems) and the loss of biodiversity in the aforementioned region during the considered time interval.
